Notice Regarding Legislative Changes Affecting Division of Consumer Protection Registrations


During the 2026 General Legislative Session, the Legislature passed SB 38, which takes effect on May 6, 2026. This bill modifies registration and compliance requirements for the statutes enforced by the Division.

SB 38 Notice to Earned Wage Access Services

Important Instructions

The Earned Wage Access Service Act, effective on May 7, 2025, establishes guidelines and requirements for companies offering earned wage access services to Utah consumers. These are businesses that allow access to earned but unpaid income before scheduled paydays. For information regarding the requirements for businesses that meet the definition of an Earned Wage Access Service please refer to Utah Code § 13-78.

Important for providers operating in Utah: the registration with the Utah Division of Consumer Protection began on May 20th, 2025, but is not required until October 6, 2025.
