Notice Regarding Legislative Changes Affecting Division of Consumer Protection Registrations
During the 2026 General Legislative Session, the Legislature passed SB 38, effective May 6, 2026. This bill modifies registration and compliance requirements for the statutes enforced by the Division.

To assist with the Fitness Center registration, please carefully review the Fitness Center Facility Application Instruction Sheet, the Fitness Center Services Protection Act and the Administrative Rules.
A fitness center is defined by Utah Code § 13-23-101(4)(a) as a business enterprise that provides access to a facility for a charge or a fee and for the development or preservation of physical fitness or well-being through exercise, weight control, or athletics.
A fitness center may not operate a health spa facility in this state unless the health spa registers the fitness center facility with the Division of Consumer Protection. Additionally, each fitness center must obtain and maintain a surety bond or certificate of deposit, unless exempt pursuant to § 13-23-105.
